HARBORVIEW RV PARK  PARK GUEST AGREEMENT

Harborview RV Park Guest Agreement (“Agreement") is made and executed this _____ day of _______________, 20___, by and between Harborview RV Park, its owner's Jeff & Michelle Borges, Michael & Sabrina Strickland & Marc & Jamie Strickland, jointly and severally as ("Owner or owners”) and ____________________________ ________________, jointly and severally ("Guest").

 

 

 

 

 

Upon approval of applicant, receipt of payment and space availability RV space shall be issued.

 

 

 

 

 

 

 

Harborview RV Park cannot be used as your permanent address.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

  • Term.  The term of this Agreement shall be: Commencing ____________________, 20___, and terminating ____________________, 20___.    Monthly rates are based on 30 night periods. Guest shall vacate the space in the condition it was received.  Agreement does not create a tenancy or residency in favor of guest. Guest must depart by the check-out time on the day indicated above. If guest fails to timely depart higher daily rate shall accrue and Harborview RV Park and its owners may provide guest three (3) days’ notice to vacate by posting the same on guests RV or by sending the notice to guests street or email address on file. Following the expiration of three (3) day notice period, Harborview RV Park and its owners may remove and store or have removed, guests RV, vehicle and other property at guests expense. The remedy described in this paragraph is in addition to any other rights and remedies Harborview RV Park and its owners may have at law or in equity. Upon approval of applicant, space availability, and receipt of payment your RV space will be issued.  

     

  • RATES, OTHER CHARGES  

     

    • Daily rate shall be_______    

    • Weekly rate shall be______  

    • Monthly thirty (30) nights  rate shall be_________

    • Local taxes shall be added to all reservations under a 30 night stay.  Monthly  rate guests may have an opportunity to stay for a maximum of up to six (6) consecutive 30 night periods.  RV must vacate the park for a minimum of 4 consecutive nights prior to termination date of Guest Agreement. There shall be no exceptions to this rule under any circumstances.

    • Option to renew is not guaranteed and shall be at the sole discretion of Harborview RV Park and its owners.  Harborview RV Park and its owners must be notified 30 days prior to any changes or early departures. Monthly rates to be paid in full in advance (late fees shall be charged if monthly rate is not paid in full in advance). Late fee of $25.00 per day after 3 day grace period.  Any stay of less than 30 night segments shall be converted to Daily rate or Weekly rate.  Failure to pay in advance will result in the rate changing to a daily rate and/or eviction immediately thereafter.

    • Returned check fee of $25.00 will be charged.

       

       

       

                   

       

       

                   

       

  • UTILITIES INCLUDED IN SPACE RENT:  Wi Fi,  Water, Garbage, Sewer. Electric usage is sub-meterd, you are only charged for actual usage at end of month.  Owner shall not be liable for, and Guest shall not be entitled to, any abatement or reduction of rent by reason of any failure to furnish any of the foregoing utilities, when such failure is caused by accident, breakage, repair, strikes, lockouts or other labor disputes of any nature, any force majeure, or by any other cause, similar or dissimilar, beyond the reasonable control of Owner.  Owner shall not be liable under any circumstances for loss of or injury to property, however occurring, through or in connection with or incidental to any failure to furnish any of the foregoing utilities, with the exception of willful misconduct or gross negligence of Owner.  Guest shall not connect, except through existing electrical outlets, natural gas or water pipes on the Space, any apparatus or device for the purpose of using electricity, natural gas or water.

  • OCCUPANCY: Two (2) person’s maximum per space. Four (4) guest’s maximum as visitors, no overnight stay with occupants. Two (2) pets maximum.

  • RULES AND REGULATIONS:  Guest is subject to and agrees to comply with all

    (Harborview RV Park Rules and Regulations), a copy of which is included hereto and incorporated herein by reference. Guest herby acknowledges receipt of the current Harborview RV Park Rules and Regulations. Harborview RV Park and its owners may modify the parks (Rules and Regulations) from time to time at its discretion. Guests also agrees and acknowledges that failure to comply with all Harborview RV Park Rules and Regulations will constitute material default of this agreement and will be cause for  immediate eviction and removal  from the RV park. ***Guest Initial_______________

  • CANCELLATION AND REFUNDS:  All reservations must be paid in full at time of reservation. Once reservation has been made and space reserved, a $50.00 cancellation or modification fee shall apply for any cancellation or modification.  Payment is non- refundable thirty (30) days or less prior to reserved check in date.  All reservations made during the 30 days or less period prior to scheduled arrival date shall be non-refundable. No refunds for Guests who depart prior to the originally scheduled departure date. When a refund is warranted, Guest herby acknowledges that a refund of payment made by check may take up to thirty (30) days. Except as expressly set forth in the Agreement all cancellations and refunds will be made at the sole discretion of Harborview RV Park and its owners. Guest may not transfer Guests reservation or occupancy of a space to a third party without Harborview RV Park and its owner's prior written consent given at its discretion. No cancellations may be made by leaving a voice mail message or e-mail.

  • QUIET HOURS: 9:00 pm to 8:00 am. Radios, televisions and other electronic devices should never be played loud enough to be heard outside of Guests assigned space at any time. This includes any loud noises or loud conversations.

  • CONDUCT: Please try and be respectful and limit any loud conversation, boisterous play, or disrespectful conduct to other Guests at all times. Harborview RV Park and its owners may require any person to leave, without refund, for any reason including, without limitation, disrespect to management or other guests, excessive consummation of alcoholic beverages, objectionable behavior, or violation of any rule or sign.

  • CHILDREN:   Guests are responsible at all times for the safety and behavior of Guest’s children. Guest must supervise all children in common areas of the park.

  • NOT A MOBILEHOME OR RESIDENCE:  Guest herby acknowledges and agrees that Guest’s and RV are permitted for a short term vacation stay only.  Agreement is one of a property owner renting a generic RV parking space on a temporary, short term basis.*** Guests Initial:_____. No permanent residence situations are allowed or implied under any circumstances. This agreement does not create a tenancy or residency or any other real property right in favor of Guest. (Not a mobile home as defined by California 2015 Mobilehome Residency Law). Short term vacation space only!

  • PROHIBITED USES: Guest shall not use or permit the Space, or any part thereof, to be used for any purpose other than placement of a single recreational vehicle to be used for vacation for the persons named herein, all of whom must comply with all duties and obligations imposed upon Guest hereunder regarding the use and occupancy of the Park and Space.

     

    I understand and agree to the foregoing prohibition on using my recreational vehicle as a permanent residence.

  • Sale of Recreational Vehicle in Place Prohibited and Subleasing Prohibited. Guest is prohibited from selling Guest’s recreational vehicle in place in the Park. Such vehicle must be removed from the Park by Guest or any third party to the exception of willful misconduct or gross negligence of Guest. Guest shall not connect, except through existing electrical outlets or water pipes on the Space, any apparatus or device for the purpose of using electricity, or water.

     

     

    Guest may not use the recreational vehicle as a permanent residence. But shall instead keep a permanent residence elsewhere and visit the park on a temporary basis.

     

  • LIABILITY: Guest is responsible and agrees to indemnify and hold harmless Harborview RV Park and its owners for all loss damage or injury to any persons or property caused by Guests invites, visitors, friends of Guest and any accompanying pets with the afore mentioned.

  • LIMITATION OF LIABILITY – Harborview RV Park Guest specifically acknowledges and agrees that Harborview RV Park and its owners any/all management, officers, directors, employees and agents of Harborview RV Park, are not responsible for any loss, damage or injury to any person or property except to the extent caused by the gross negligence or willful misconduct of Harborview RV Park and its owners.

  • INDEMNIFICATION: Except for losses, damages or injuries for which Harborview RV Park and its owners are responsible pursuant to section limitation of liability above, Guest will indemnify and defend Harborview RV Park and its owners, the RV Park property owner, and all management, officers, members, directors, employees and agents of Harborview RV Park and its owners, for, from and against any and all claims, damages, liabilities, costs and expenses (including, without limitation, court costs and attorney fees) arising out of or related to this agreement or any actions of Guest.

  • SEVERABILITY: The invalidity or unenforceability of any provision of this agreement will not affect the validity of any other provision of this agreement and, in the event that any provision is determined to be invalid or otherwise illegal, this agreement will remain in effect and will be construed in accordance with its terms as if the invalid or illegal provision were not contained herein. 

  • APPLICABLE LAW/JURISDICTION/VENUE: This agreement, and all collateral matters relating to this agreement, will be governed by and construed under the laws of the State of California applicable to agreements fully made and performed therein. Jurisdiction and venue for any claim or proceeding brought in connection with this agreement will lie exclusively in the state or federal courts located in San Luis Obispo County, California. 

  • LATE FEES AND INSUFFICIENT CHECK FEES: In the event payment is not paid by the date it is due, as defined herein, Guest will pay a late fee of $25.00 per day commencing after a 72 hour grace period. In addition, Guest will be deemed to be in default of this agreement and the entire unpaid amount. In addition balance due shall accrue interest at a rate of %18 per annum until paid in full. In the event any check from Guest to  Harborview RV Park and its owners is returned or dishonored by the bank for insufficient funds or any other reason Guest is liable to Harborview RV Park and its owners for any actual costs incurred by Harborview RV Park and its owners by reason of such dishonored check including a processing fee of $45.00. Guest agrees to pay the processing fee and replace the dishonored check with certified funds within twenty-four (24) hours’ notice of dishonored check. Thereafter, Harborview RV Park and its owners may require any and all future payments be made by money order or certified check.

  • DEFAULT: In case of necessity of an action at law or equity to remedy any breach under the terms of the Agreement (including the “Park Rules and Regulations”) the party found to be at fault shall pay damages incurred plus reasonable attorney’s fees and court costs, including paralegal fees, necessitated by the enforcement provisions of the Agreement. In the event of a default and at the request of Harborview RV Park and its owners, Guest agrees to immediately vacate the RV Park and to immediately remove his or her RV and personal property. Guest’s failure to comply with any of the terms of this Agreement shall constitute a default of this agreement and Harborview RV Park and its owners shall be entitled to all the remedies as set forth and as provided by law.

  • WAIVER: No failure or delay by either party in exercising any rights, powers or remedies under this Agreement will operate as a waiver of any such right, power or remedy.

     

  • PET OWNER RESPONSIBILTY AGREEMENT: the specific rules and regulations related to Pet Owner’s responsibilities contained in this paragraph are a material part of this Agreement. The undersigned Guest (and all occupants of the Guest’s RV) hereby agree to comply fully with all of the Pet Rules and Regulations set forth herein. Guest further agrees that if Guest fails to comply with any of the Pet rules and regulations, Guest will be in default of this Agreement and Harborview RV Park and its owners will be entitled to all the remedies set forth in this Agreement, including but not limited to the immediate removal of Guest from the RV Park. Harborview RV Park and its owners shall also be entitled to recover its damages including attorney fees and costs incurred in enforcing the Agreement.

     

     

    • All pets must be kept on a leash or in a cage or crate at all times during which the pet is outside of your RV. Pets must be supervised at all times. Please be advised that pets found unsupervised in the RV Park may be impounded.

    • Pets are not permitted in other Guests site.

    • All Guests are required to clean up after their pet(s). Harborview RV Park and its owners reserve the right  to assess a $25 per occurrence fee if you fail to clean up after your pet(s)

    • Barking, excessive noise or other pet behavior that disturbs other Guests is not permitted. If Harborview RV Park and its owners become aware of such behavior, management will notify you and request that you take action to correct the problem behavior. If such behavior continues after the second notice you receive from management you will be required to remove the pet from the RV Park within 24 hours after notice from management.

    • Pets are not permitted to be tied or chained to trees or other objects within the park.

    • You certify that your pet has not previously bitten or caused injury to any person. If at any time your pet bites or otherwise injuries any person or other pet at the RV Park, you will be required to remove the pet from the RV Park immediately and the pet will no longer be permitted on the RV Park premises.

    • If your pet displays threatening or aggressive behavior which Harborview RV Park and its owners, in its sole discretion, deems to be dangerous or problematic, you agree to promptly vacate the park upon request from Harborview RV Park and its owners. You also agree to no recourse against Harborview RV Park and its owners and no claim for reimbursement or compensation from Harborview RV Park and its owners.

    • You agree to indemnify, defend and hold harmless the RV Park Property Owners, Harborview RV Park, and their principals, members, shareholders, partners, directors, managers and employees from and against and any and all claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys’ fees) arising out of or in connection with your pet residing or being located at the RV Park, including, without limitation, the claims of any third parties related to death, bodily injury or damage to persons or property caused by your pet.  

    • In its sole discretion, Harborview RV Park and its owners can limit or restrict which pets are permitted at the RV Park. Breeds of dog not permitted at the RV Park include but are not limited to Pit Bulls, Staffordshire Terriers, Doberman Pinchers, Rottweiler’s and Chows. Notwithstanding the foregoing service dogs of any breed belonging to a Guest are permitted at the RV Park.

    • Failure to strictly comply with these pet rules and regulations will constitute default of this Agreement. Also your failure to disclose and identify existence of your pets to management will constitute default of Agreement and Harborview RV Park and its owners will be entitled to all remedies set forth herein.

  • ENTIRE AGREEMENT:  This Agreement constitutes the entire Agreement and understanding between Harborview RV Park and its owners and Guest and supersedes all prior or contemporaneous oral and written agreements and representation between the parties. The “Guest Rules and Regulations” are incorporated herein by reference as part of this Agreement. This Agreement may not be amended, modified or altered except in writing as signed by Harborview RV Park and its owners and Guest. The Guest(s) signing this Agreement represents that he or she has the authority to sign on behalf of all occupants of Guests designated RV and acknowledges that this Agreement is enforceable against all occupants of Guest’s RV and Guest.
